By downloading, accessing, or using our app and services ("Service"), you agree to these Terms, including any updates. If you do not agree, please do not use our Service.
1. Introduction
These Terms govern your access to and use of the MindTunes mobile application and related services. By creating an account or using any part of our Service, you accept and agree to be bound by these Terms.
We reserve the right to modify these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
2. Eligibility
- You must be at least 18 years old to use our Service.
- By using the Service, you represent and warrant that you are 18+ and that any information you provide is accurate and up to date.
- If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.
- We reserve the right to verify your age and suspend or terminate accounts that do not meet eligibility requirements.
3. Scope of Service & Disclaimers
Important: Our Service is NOT a substitute for professional medical or mental health care.
- Our Service offers mental wellness support and informational resources—not professional diagnosis, advice, or treatment.
- Content is provided "as is" and for general informational purposes only.
- The AI-powered wellness coach and other features are tools to support your wellness journey, but they do not replace licensed professionals.
- Emergency Situations: If you are experiencing a mental health crisis, suicidal thoughts, or any emergency, you must seek immediate professional help:
- Call 995 (Singapore emergency services)
- Contact Samaritans of Singapore: 1800-221-4444
- Visit your nearest hospital emergency department
- Consult a licensed mental health provider
- The Service is not suitable for crisis situations or urgent medical needs.
4. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to notify us immediately of any unauthorized access or security breach.
- You are responsible for all activities that occur under your account.
- We reserve the right to suspend or terminate accounts that violate these Terms or engage in harmful conduct.
- You may delete your account at any time through the app settings. Upon deletion, your data will be handled according to our Privacy Policy.
5. User Conduct
You agree to use the Service lawfully and ethically. You must not:
- Misuse the Service or attempt to gain unauthorized access to any systems or data
- Harm, harass, threaten, or discriminate against other users
- Infringe on third-party intellectual property rights, privacy, or other rights
- Submit content that is false, misleading, offensive, defamatory, obscene, or unlawful
- Use the Service to promote illegal activities or distribute malware
- Scrape, mine, or extract data from the Service using automated tools
- Impersonate any person or entity, or falsely state or misrepresent your affiliation
- Interfere with or disrupt the Service's functionality or security
Violation of these conduct rules may result in immediate account suspension or termination without refund.
6. Intellectual Property
- All app content, including but not limited to text, graphics, logos, videos, software, and data, are owned or licensed by MindTunes.
- Our trademarks, service marks, and logos are protected intellectual property.
- You may not copy, distribute, reproduce, modify, or create derivative works from any part of the Service without our prior written permission, except as allowed by law for personal, non-commercial use.
- User-generated content (e.g., journal entries) remains your property, but you grant us a license to use, store, and process it to provide the Service.
7. Personal Data & Privacy
- We handle your personal data according to our Privacy Policy, which you must read and agree to.
- We store and process your data as needed to deliver the Service, in compliance with Singapore's Personal Data Protection Act (PDPA) 2012.
- Your self-reported wellness data may be retained while your account is active.
- You have the right to access, correct, or delete your personal data as outlined in our Privacy Policy.
- We will comply with data deletion requests made through the proper process, subject to legal retention requirements.
8. Subscriptions & Payments
- Some features of the Service may require payment or subscription.
- Subscription fees are charged in advance on a recurring basis (monthly, annually) as selected by you.
- Prices are subject to change with at least 30 days' notice.
- Payment processing is handled by secure third-party providers (e.g., Stripe, PayPal).
- Refund Policy: Refunds may be granted on a case-by-case basis within 14 days of purchase for unused subscriptions. Contact admin@yourmindtune.com to request a refund.
- You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Promotional credits (e.g., the 100 free credits offer) are non-transferable and subject to expiration as specified.
9. Disclaimers & Limitation of Liability
To the fullest extent allowed by law:
- The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied.
- We do not warrant that the Service will be uninterrupted, error-free, secure, or meet your specific requirements.
- We are not liable for any indirect, incidental, consequential, punitive, or special damages arising from use of the Service.
- Our total liability to you for any claims shall not exceed the amount you paid us in the 12 months preceding the claim (or SGD 100, whichever is greater).
- Exception: These limitations do not apply to liability related to fraud, death, or personal injury resulting from our negligence, as required under Singapore law.
10. Indemnification
You agree to indemnify, defend, and hold harmless MindTunes, its employees, directors, partners, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your breach of these Terms
- Your use or misuse of the Service
- Your violation of any third-party rights
- Any content you submit or share through the Service
11. Third-Party Links & Services
- We may include links to external websites, apps, or tools operated by third parties.
- We do not endorse, guarantee, or control these third-party services.
- We are not liable for any issues, damages, or losses arising from your use of third-party services.
- Your interactions with third-party services are governed by their own terms and privacy policies.
12. Modifications to the Service
- We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
- We may add or remove features, change pricing, or update content at our discretion.
- We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
13. Modifications to These Terms
- We may update these Terms at any time to reflect changes in our practices, legal requirements, or business operations.
- Changes will be posted in the app or on our website with a new "Last Updated" date.
- For material changes, we will provide notice through email or in-app notification.
- Your continued use of the Service after such updates indicates your acceptance of the new Terms.
- If you do not agree with the updated Terms, you must stop using the Service and may delete your account.
14. Termination
- By You: You may terminate your account at any time by contacting us or using the in-app account deletion feature.
- By Us: We may suspend or terminate your account immediately, without notice, if you violate these Terms or engage in conduct harmful to the Service or other users.
- Upon termination, your right to use the Service ceases immediately. We may delete your account data as described in our Privacy Policy.
- Termination does not relieve you of obligations incurred before termination (e.g., unpaid fees).
- Provisions of these Terms that by their nature should survive termination (e.g., disclaimers, indemnification) will remain in effect.
15. Governing Law & Dispute Resolution
- These Terms are governed by and construed in accordance with the laws of Singapore.
- Any disputes arising from or related to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Singapore.
- Before initiating legal action, you agree to attempt to resolve disputes informally by contacting us at admin@yourmindtune.com.
- If informal resolution fails, disputes may be resolved through mediation or arbitration as mutually agreed.
16. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MindTunes regarding the Service and supersede all prior agreements, understandings, and communications.
